Are Home games legas

Any opinion would be greatly appreciated. Are home games legal. I live in NY. Some have told me that the only thing that makes it illegal is taking a rake on cash games. Others have told me that taking money on tournaments is illegal. But I dont understand because if the person is renting space and had to buy the chips and tables full and pay the dealers why is it illegal.

How about it is illegal because it is gambling and you don't have a license/permit...

Its only illegal if you get caught in some states and only if you are stupid and broadcast it in your city.

Besides, who is to say anything about anything?

each state is different so check your local laws, in most states it is legal as long as there is no rake, and you do not charge your players a fee to play. Basically all money paid in has to be paid out to the winners.
