I've lived in played in Thailand for the past 3 years where it is illegal. I imagine it is the same in India. Not locally enforced. Some sites do restrict cashier activities from IP's located in countries where gambling is illegal, while a couple block access completely... This are done at the server level though.

Online Poker at Pokabunga.com

Online Poker is just beginning to grow in India now. There are a lot of fishy websites that allow play through the ewallet. You should check out Pokabunga.com if you wanna play if safe and legal. They have payment options directly from the bank.

Actually as per the Supreme Court statement games which require skills are not to be considered as gambling in India. Thus, the game Rummy which is very popular in India and other games which requires a skill can not be banned. Poker also requires a skill to win rather then only chance(luck) so technically it is legal. But there is not statement I found just like the statement for the Rummy is given by the Supreme court of India.
